Using my super powers of intellectual property law, I have found and confirmed the trademarks applied for at the European OHIM. They're from Nintendo and apply to all the right categories of goods and services. It all seems very legit. Whether or not it's a next gen game is obviously still unknown, but yeah.

Determination of penalty for criminal offences is an extremely complex subject (so much even that it was an entire separate class for a full semester in my Master's), so I'm not going to pretend to know much about how it works in Canada at all, but I'm pretty sure that people still end up with much harsher sentences than that. Can't forget about things like mitigating circumstances and fluctuating categories of crime that could have come into play here. Canada's Criminal Code states: (4) Every person who possesses any child pornography is guilty of (a) an indictable offence and is liable to imprisonment for a term of not more than 10 years and to a minimum punishment of imprisonment for a term of one year; or (b) an offence punishable on summary conviction and is liable to imprisonment for a term of not more than two years less a day and to a minimum punishment of imprisonment for a term of six months." No clue about the average sentences that people in possession of child pornography get in Canada, but they could get up to 10 years for it. 5314

For those wondering, it is entirely possible under numerous jurisdictions for a minor to get in trouble for possessing or producing child pornography. It's not that uncommon for a minor to end up facing charges for spreading nude pictures of him or herself, or for possessing sexual images of people their own ages. There's numerous recorded cases in, for example, the US and Canada of something like this happening.
Most countries employ the strategy of simply not prosecuting these people when they're minors or seeking different and extrajudicial measures to deal with them. Others have settled case law (Canada has a supreme court ruling in R. v. Sharpe, for example) that applies certain restrictions and allows it when the teens are in a relationship or when the pictures are never shared or spread any further. Europe and the EU are currently the leaders and forefront of improving these situations. Both the CoE's Lanzarote Convention and the EU's Directive on child pornography explicitly allow for national exceptions for minors. 5315

From what I can tell, your brother is neither particularly smart nor "intellectually mature to know right from wrong". It's normal to think more of people we're close to, but you can't let it cloud your judgement. Your brother needs your support, but he also needs to understand that this is not okay and that there might be consequences for what he's done. He's at an extremely impressionable and young age where things like this can shape him quite a bit. Coercing a very troubled girl into giving him nude pictures could be what starts him down a path to a lot worse than just that. My knowledge of Canadian criminal law is pretty shaky, but I can give you my opinion on the legal side if you'd like. 5330
