Here is the source material I was talking about, clearly showing that gang related killings only make up about 10% of all gun homicides. And mind you, this is about ALL gang related killings, including those commited by fists, knives or any other tool.
In conclusion, only a small fraction of all gun homicides are gang related. It's a common misconception among the pro-gun crowd that all gun homicides are commited by out of control gangbangers while the virtuous and respectable "law-abiding gun owners" rarely ever use their firearms for anything other than saving the lives of innocents. I've had this exact discussion before on B.net, probably with Kinder or some other extremely pro-gun member. 14650

Regardless of whether it does exist or not, moral responsibility, or simply the concept that our state of mind or past has bearing on how our actions are to be judged, should never be equal to legal responsibility.
I am taking a very interesting class on things like this that I think you would find very interesting Meta. It's called Criminal Sanctioning Law and deals with the more abstract aspects of punishing criminals. The whole debate about to what extent someone's past and concrete, individual situation and context should be taken into account with a sentencing plays a significant role in it. 14662
