I know you're quite clearly more socially liberal than I am, but I have no idea where your economic opinions lie (which I, admittedly, place a lot more emphasis on when considering somebody's "aggregate label".
I'm afraid I'm gonna have to disappoint you then. Along with economics in general, economic/business/fiscal law are all to a certain degree mandatory subjects I've had to study. I like to think I'm relatively knowledgable in those areas, but they're not what I'm interested in or feel like debating in detail. Nothing personal of course, I'm just not interested enough in economics to further educate myself and get acquianted with its details and finer aspects. To answer your question though, I do believe that the smarter and more knowledgable you are, the more you'll find yourself in a certain direction. However, things like economics, law and social policies are no exact science, so it is entirely possible that two incredibly knowledgable and intelligent people still have entirely different opinions when it comes to a certain policy.

Retribution can certainly be important for restoration, too, but I'd argue we need something of a social paradigm shift to not see justice as retribution, but to realise that society isn't atomistic and that justice, properly constituted, involves reaching the best social outcomes.
Agreed, although this last part is going to be incredibly hard to realize. As long as humans have feelings and a sense of individualism, I doubt we're ever going to reach the point where (the majority of) people are going to completely abandon their personal interests and feelings for the greater good of society. Everybody has their own idea of "justice", especially those personally involved with a crime or terrible event. You would've not done too bad in law, by the way. I feel like a lot of my classes would interest you. I'm currently taking Criminal Sanctioning Law, which deals exactly with these issues and the more abstract / philosophical aspects of the (ideal) workings of the justice system.

I don't see that as a tenable position in any way whatsoever. Despite the philosophical issue with retributive justice needing free will as a foundation (when free will, to anybody willing to meaningfully engage with the idea, doesn't exist) there's simply no good reason why basing an ethical code on punishment is beneficial.
To be fair, punishment is and will always be a part of the criminal sanctioning procedure. It should never be the main reason, but retribution or at least the feeling of justice being done is a part of the mourning/moving on process of many victims.

Subjective Of course it's subjective. This is law we're talking about. Every legal system and piece of legislation is inheritently based on the subjective opinions and values of a society. Pointing this out does nothing to discredit what I said, as no one should be bothered to put "imo" or "subjectively" after literally everything they say. Why should we treat a criminal who has killed and raped multiple people in a gentle manner when they didn't do so to their victims?
Because we're better than him. "He wronged us, let us resort to doing upon to him what he did to us." We as a society should move past that, as mine already has. Vengeance is not justice.

Well, it appears Utah's going against the trend. Maybe not as far, but still.
I've thought of another way, this one is a bit less inhumane than shooting, and far more than gassing. I assume the US has a steady supply of heroin being confiscated from drug users/dealers.Rather than destroying it, inject into death row's inmates, to the point of OD'ing. Wouldn't the drug itself take away the pain, like morphine? Plus your almost guaranteed a supply due to the illegal drug trade and proximity to South America, and then it also saves on energy and money by not destroying it.
As far as I'm aware, depending on what you overdose on, it ain't always pretty. Swelling, vomiting (and the following choking on the vomit), blood clothing, bloating, perspiration, heart attack... are all symptoms that often go along with OD'ing.

Because we as a society are looking to progress, not regress. The death penalty is inhumane as it is and has no place in the developed world. That debate aside, however, suffocating and gassing people to death is blatantly cruel and unnecessarily painful. It should not even be considered.

I plan to get one after I have a carry piece.
We also make awesome rifles and such, I've been told.
FN rifles have a great reputation, but are very expensive.
