I don't think anybody has ignored that. You, and a few others, responded to Turkey's post when he brought it up.
Then this is a pretty easy to judge case. What's the discussion? She wasn't arrested for simply being racist.
The discussion is whether it's right or necessary to also tag the crime with Islamophobia.
My personal opinion is that hate crimes are real, and should be persecuted more severely. To me, what separates a crime and a hate crime is the intent. If I shoot you for say your wallet, just you are the victim. If I shoot you because you're Muslim, my intent is to terrorize the entire Muslim community. The scope of victims is much broader.
Sure, in both cases you are just as dead. But in one just your family is traumatized. The other an entire community is.
And Muslims get extra special victimization points, why?

I support total legalization of almost every recreational drug. I'm just providing the legal reasoning the courts have used for decades to justify drug prohibition.
Okay, but not really sure why you're appealing to the law when we're clearly trying to debate the merit of it.
Because I was asked by two people what the legal basis of the government's prohibition on drugs is and felt like contributing to the thread academically instead of the usual echo chamber about immutable liberty and such.
The OP specified whether it is a right the government should reserve. It's all very nice clarifying the logistical basis of criminalizing drugs, but that's not really what we're here to discuss, is it?
