The problem with this entire situation is that the only people who know the truth have different stories. Someone is lying and it's not fair to point fingers at the person you suspect on a hunch.

I don't get your point. I'm not a judge, I'm a person who almost exclusives thinks on his instincts. It's similar to the OJ verdict where everyone knows he did it even though the courts proved him innocent. The "Court of Public Opinion," as it were. If I was a judge, even if I felt as I do, I would still want a full impartial investigation into the matter. Fuck, I still want that and I'm not a judge. I even admitted earlier that if he was proven innocent after a legitimate investigation I would accept those results and eat my words.

That's precisely what would happen though. There is no evidence of a crime that may or may not have happened forty years ago.

That's a separate problem and I don't think you'll find one respectable, liberal person who would argue against equal punishment against false accusations.

More replying to Chally without going through the work of actually replying to him.

Equal punishment for false accusations is also a pretty sticky situation. If the police don't find any evidence of rape but nothing to directly refute it who gets punished? I'm sure less women will come forward with allegations if the threat of jail time is a possibility. For a crime that goes mostly unreported, having less women (or men) come forward is not an ideal outcome.
