Scenario 1: A man rapes a woman, she gets pregnant and gives birth. Under any circumstances, should the rapist have any amount of custody over the child, and should he be required to pay child support?

Scenario 2: A woman rapes a man, she gets pregnant and gives birth. Who should get custody over the child, assuming both want it? Should the woman have to pay child support?

Scenario 1: No to both questions.

Scenario 2: As much as it begrudges me to say, neither. The state should take custody of the child, as clearly neither parent is capable of raising a child to adequate standards (the father never intended to conceive a child, and the mother is clearly a psychopath, as are all rapists regardless of gender). Although seeing as how skewed the judicial system is towards women, I doubt this would be a realistic scenario.

Scenario 1: No custody at all, a sex offender of that degree should not be allowed near children let alone be responsible for one. If the woman doesn't want custody then the child should be placed into care. Yes they should be required to pay child support regardless of whether the mother holds custody (Paid to the state/carer instead)

Scenario 2: No custody at all for the mother, a sex offender of that degree should not be allowed near children let alone be responsible for one.  If the man does not want custody the child should be placed into care. Yes they should be required to pay child support regardless of whether the Father holds custody (Paid to the state/carer instead)

It seems copypasted but that's pretty much because the response is the same for both scenarios in my mind.

Scenario 1: I'd suggest an abortion tbh, but for the sake of the thread Id say let the mother have custody (she obviously wants the child) and yes the father should be forced to pay child support. You could argue it's not fair but rape is one of the worst things you can do, you deserve whatever happens to you.

Scenario 2: The decision should be up to the father, if he wants custody give him priority over the mother. He also shouldn't be forced to pay child support but if he wants to then its his choice.

I would say so, someone with that sort of pathology isn't fit to be near children. This is violent rape we are talking about though right? <.< If it's one of those more borderline alcohol fueled cases that get people so worked up I could see the arguments for and against but someone who assaults another person in that way is not fit to parent.

No.

Depends on the "rape".

In a back alley with a knife? Fuck yes. A drunken mistake which wasn't clearly a rape, but still deemed one by our retarded judicial system/culture then yes, there should be the opportunity for custody.

Scenario 1: no. Yes.

Scenario 2: I don't trust your average rapist to make for a decent parent, and I don't expect a victim of rape to be automatically become the caretaker of a child they may well won't want. If the father doesn't want the child, then I suppose it's up to the orphanage for the child, unfortunately. If the man is willing to accept custody, then I don't see why he shouldn't get child support from his rapist.

It's less cut and dry with the second scenario, because even if the father wants custody, you can't force someone to go through labor. You can pull "oh but she raped someone she deserves everything we can throw at her", but mandating childbirth isn't a reasonable punishment.
