Trans people (especialy trans men, as they usually get better beards than I can grow) have been going in to the opposite bathroom for decades now, but it's always kind of been at their own risk of being found and arrested.
It's been a blind spot for years but now that it's in the spot light, it needs to be resolved

There's nothing stopping a gay person from perving on the person the next urinal over either. It just seems like something meaningless to worry about considering the bathroom has never been a safe haven away from people who may find you sexually attractive.

My point is that pervs will perv, regardless of what sex/gender restrictions a bathroom has. You can't remove a possibility like that unless you redesign bathrooms to be completely separate individual stalls with their own walls separating them from other stalls.

Well, how many cases of gay people perving on others in the bathroom do you hear of? I can't really think of any.
And considering that transgenders are a far smaller group than gays, do you really think their will be a spike in bathroom related incidents seeing as how we have not had that problem with larger LGBT minorities?
Outcome does not matter at all I'm sure no incidents have occurred in the past and very few will occur in the future But now that it is at the forefront of political discussion, it needs to be resolved in a way that there are no backdoors or loopholes and so everyone can feel safe, not just transgenders

What law Civil Rights Act of 1964 says nothing about trannies
It was used to strike down state set high requirements for police officers. I'm more than sure there's a proper legalese way of making it work in a court, considering that the act of '64 does include Women's' Rights and parts on sex or gender discrimination. It went far beyond just desegregation.
The bathroom is, by nature, a discriminatory place It's suppose to separate men and women So using gender identity is a clear loophole to that and it doesn't fall under the Civil Rights Act
But it's clear in today's political and judiciary environment that transgendered individuals are in fact a recognized and therefore protected minority group. An individual who is transitioning therefore should have (under the pretense of prior legislation passed) be freely allowed to utilize the bathroom of their gender identity without fear of legal repercussions.
Of course But from a legal standpoint, making a law based on "you do what you feel like" is not good Plus You cannot prioritize .3% of the population when it affects 99.7% of us too But that's how America is today If you're part of a victimized group, you can do whatever you want
