[the] reach of the statute puts it in conflict with the First Amendment... the statute would apply with equal force to personal, whispered conversations within a home."[26]

The Act was ruled rightly unconstitutional a few years ago. It was replaced in 2013 by a new one that only criminalized pretending to have received medals for the purpose of receiving tangible benefits. To my knowledge, simply saying you have one or even owning a fake one isn't at all illegal, and neither is claiming you're military when you're not (unless it's to claim certain illegitimate benefits).
