Okay, this has come up often, but if you send a nude photo to someone, does the receiver have the permission to do what they want with it. Does it also include spreading it over the internet.

This issue has confused me because although i believe the biggest issue is whether the receiver of nudes has rights to send or distribute them.

Cause this comes down to the question that the sender gave it to the person on the basis of privacy that it will be between both of them. A tort per say.

In canada the internet is called a publication media. Thus posting it online is considered a violation of te creater aka the senders right.

Also is there a contractual agreement that exist when the person sends a nude photo from one person to another. A contract of it being btwn both parties unless the distribution rights of such images or products are given by the sender.

Unless you sign a contract, I don't see why they can't do what they want.

But is this not a tort or common sense. I mean she gave you in privacy and common sense is it must be kept between you and the sender. Look up tort(common law jurisdiction). It also asks because distribution rights were not passed on to the receiver of the nudes.

Personally, I don't care about the legal ramifications, if you send that out to someone you should be prepared for them to be spread out. You can take lawsuit against that person if they do, but it's not going to take anything back.

It matters, it's just that it won't help anyone at the end of the day. You can't go around making the people that saw it "unsee" the images, so that's that. Yeah, some poor SOB can get jail time, and that's kinda dumb(unless the pics were underage), but the laws are partly in place to screw poor saps over.

I really don't see a point in policing the matter, if you're willing to trust someone like that and they betray you, then you should learn from it, not try and get 'justice' by locking the person who spread the pics in jail to make you feel good.

People make stupid decisions when they are in love. I expect as much from couples. There is that expectation of trust that exists. The law though exist and some people accuse it for being censorship.

If you send a picture to someone, know that there is a chance it might end up online. You've "publicized" it whether you like it or not by hitting send. So keep in mind that you can't really prevent the other person from doing with they want to with your picture. Now on the other hand, if you're given nudes, you can never ever share them under any circumstance unless the other person has given you their permission. If you do, your a disgusting piece of filth who should have their hands removed.

There is a disappointingly low amount of nude photos being distributed in this thread.
