But for real, the people die if they are killed line is right out of the VN. Shirou should have died a good three times by now from physical injury, including getting pulverized from the waist down by Berserker, but he's still alive and it's confusing the hell out of Rin.

Actually, he does die, in the prologue. (Of the first route anyway.)
So him saying that makes sense. Considering he did in fact die.

Ignore the fact he gets brought back to life, that just confuses the quote and shot gets messy.

He wasn't dead yet when Rin found him. She couldn't raise the dead with that gem, just use the incredible amount of mana to heal the just about dead.
