Scalia was well-known as a strict constitutionalist. It's clearly outlined in the Constitution, in Article II, Section 2, that the President "shall nominate, and by and with the advice and consent of the Senate, shall appoint ambassadors, other public ministers and consuls, judges of the Supreme Court..."

Not that "he may appoint" or "he can choose to appoint." No. "He shall."
