The layer should know that he can't legally make you sign anything when you're drunk.
The tattoo artist should say no out of sanatary/medical reasons. Drunk people fucking bleed when you ink them.

The drunk guy should also avoid drinking around layers and tattoo artists.

And those god damn ugly fat chicks better be damn well prepared for me to yell rape the next morning.

Both are at fault. The drunk for getting so intoxicated they are incapable of stopping something they don't want (in the case of rape or a tattoo), and the exploiter for taking advantage of said drunk's intoxication to make them do something they wouldn't do otherwise.


However, in a perfect world I should be able to get as drunk as I want without fear of being exploited, so I'd place further blame on the exploiter than a drunk.(Especially seeing as much of what the exploiters are trying to do is illegal anyway.)


EDIT: A good similarity would be exploiting a disabled person. If you exploited them, you'd be at fault, whereas a drunk person can still have some of the blame if exploited because they chose to mentally/physically impede themselves with alcohol in the first place.

I'd say that the fault is with the person who is exploiting the drunk one. They should know better. Just because someone goes over the edge where they can't have much control doesn't mean they deserve everything that happens to them.
