Simple question. Does the government have the right to ban drugs?

Government has no right to tell you what you can and can't put into your body, no.

No one can take away my right to censure and ostracize you for doing them, though.

Pretty much.

To go off of that though, I don't support an immediate repeal of drug bans - not until we have concrete studies of effects and invest in research for better rehabilitation.

They've definitely got the right to ban sale and possession of drugs.

Curious as to where they are given the right?

Maybe with heroin given how easy it is to overdose, but certainly not with something as harmless as weed. Why the fuck is marijuana even banned in the rest of the 48 states anyway?

And why is that again?

Commerce Clause, Necessary and Proper Clause, and the 10th Amendment which disseminates all other powers to the states, who have deferred to Congressional laws, e.g., the Controlled Substance Act.

The government doesn't explicitly have the right to regulate what substances you put into your body, but they sure as hell have the right to regulate harmful substances from entering the economy or be produced domestically.

That's a very pedantic way of justifying the government's capacity to dictate our lives.

OT: No it doesn't. I suppose there's an argument to be made about the state's role in regulating illicit substances, just like say, guns for example, but arbitrarily declaring them inaccessible has pretty much resulted in universal failure, both legislatively and morally.

I support total legalization of almost every recreational drug. I'm just providing the legal reasoning the courts have used for decades to justify drug prohibition.

Okay, but not really sure why you're appealing to the law when we're clearly trying to debate the merit of it.

Because I was asked by two people what the legal basis of the government's prohibition on drugs is and felt like contributing to the thread academically instead of the usual echo chamber about immutable liberty and such.

The OP specified whether it is a right the government should reserve. It's all very nice clarifying the logistical basis of criminalizing drugs, but that's not really what we're here to discuss, is it?
