It's a thought experiment in game theory, it's not a commentary on criminal justice systems.

This isn't even a good example of the prisoner's dilemma, because when only one confesses the other serves more time than the sum of their time when they both confess.  It's supposed to be an example of a situation in which the most reasonable behavior from both participants results collectively in the worst possible outcome.
