How about the option to send Open messages? Open as in public, but not public, because then it's still a pm, and you're not allowed to send those when banned.

Alternatively, you could allow the option to send messages, just like on B.net when banned.

You can send messages when you're Warning banned (the red "banned" label under your avatar) but you can't when you are blacklisted.
