That's not a gameplay trailer, so you're not seeing anything representing how the game will look.
The first trailers for Heavy Rain and Beyond look like the games too basically. It's in-engine. That's the whole point lol. He likes to show off his graphics. Why would they show a CGI trailer?
Because CGI looks better, and that's obviously not in-engine.
It clearly reads at the end "Captured in-game engine"

They legally can't.
Now, whether the game will remain of that quality by the time it's released is another matter.
Remember Watch Doge? How about 'you can go over those mountains'? How about 'Every fish has an AI' The Game. Most devs these days are just businessman. Which is what theyre meant to be, but its still sour.
