That's my point. They're not theft, they're fraud. Legally speaking, two different things. Whoever gave this person food or money gave him permission to take and receive those goods. Whether or not this happened under false pretenses makes no difference, it still isn't theft.

The point is, technically, he didn't steal anything. People bought him food. If I were dressed as Pikachu and people bought me food, why the hell should I go to jail just because these people willingly bought me food because they love Pokemon? What have I done wrong? Nothing.
He did do something wrong morally. But not illegal.
I get what you are saying but dressing as military and accepting free meals is different. When you are dressing up as pikachu you aren't acting like you are an actual pokemon, and people aren't giving you money because they think you are actually a pokemon. They are giving you stuff or taking pictures because they think the pretend costume is cool. This guy only got money by tricking others into thinking he was a legitimate military person.
Anyway like I said, he shouldn't go to jail. But there obviously has to be some kind of fine or action against fraud like this.
I can agree with a fine. Because it's kind of like impersonating a police officer or federal agent.
But jail time is overkill.
Yeah a few meals doesn't equal jail. I'm just saying, people are letting the military respect argument get in the way. Half the thread is unnecessary. This is just a simply case of fraud, or a simple con. Not that controversial.

Completely irrelevant and missing the entire point. The justice system is supposed to protect those "idiots" who fall for this stuff. Obviously you have responsibility not to fall for things like fake uniforms, but when someone is caught out smarting "dumb patriotic Americans" you don't give them a pat on the back and say "good job just don't do it again". I'm not saying jail him for 60 years here, I'm just saying it's a punishable offense and he should be fined at the least.
I don't care about you guys mocking American Patriotism, I think it's over the top as well. Especially seeing how people fell for this trick. But don't connect stabs at military respect with allowing con men to get away.

From the OP he didn't ask for the food or actively try to con them. He simply wore clothes that made people's patriot dick hard to the point they had to throw money at him.
Even if it wasn't his initial intention, which I doubt, he is still responsible for the act. He accepted the gifts knowing why he was receiving them.
