The source code really has nothing to do with it. 10 is just a variation of the NT kernel, and I have no doubt it's capable of stealing all of that. But there's no evidence it's being done.
Source code is relevant, though you're right, there's no evidence. But it's unlikely that MS is so incompetent that they'd just leave a backdoor open 24/7. There's no way of knowing either way, at least with what little public information there is available right now. You're telling me my operating system can detect software on the hard disk it's running off of? And send that information back to mother base unencrypted, which presents numerous security problems in and of itself. No shit, man. And it absolutely should disable pirated software, that poses a security risk to the user and is also illegal. Okay, mom. (It's a bit concerning that you think MS should institute a nanny state. Assuming it really is a capability of Windows 10, it'd be another 'feature' tantamount to a backdoor that opens the door to abuse, not necessarily by Microsoft or the US government, but by ill-intentioned third parties. All backdoors are inherently security flaws that compromise the integrity of that system.)
