Today Lambda Legal, the ACLU and private firm Gerhardstein & Branch petitioned the Supreme Court of the United States for a writ of certiorari, the formal request that the Court review its cases challenging Ohio’s constitutional ban on marriage equality.


Earlier this month the Sixth Circuit Court of Appeals overturned lower court rulings that struck down state marriage bans in Kentucky, Michigan, Ohio and Tennessee.  This was the first time a federal appeals court ruled against marriage equality after four other federal appeals courts upheld district court rulings that the bans are unconstitutional.

The joint filing covers two lawsuits filed by Gerhardstein & Branch: Henry v. Hodges, joined by Lambda Legal, seeking to compel the State of Ohio to recognize the legal marriages of same-sex couples and issue accurate birth certificates, and Obergefell v. Hodges, joined by the ACLU, seeking to order the State to issue accurate death certificates to married same-sex couples.


Attorneys for the plaintiffs in the Kentucky, Michigan and Tennessee cases have also indicated they will be petitioning for the Supreme Court to hear their cases on appeal as well.


By filing for cert so quickly, there’s a chance the Supreme Court could take up the cases this term, although there is no set protocol as to when or if the justices decide to hear a case.

Can't say I'm too surprised after how the 6th Circuit ruled.

  • In July, 19-year-old Pi Kappa Phi pledge Armando Villa of California State University, Northridge, died on a fraternity trip. Sheriff's investigators ruled the death to be hazing-related.
  • In March, 18-year-old Phi Sigma Kappa pledge Marquise Braham of Penn State University committed suicide after what his family claimed was repeated hazing. While not explicitly linking Braham's death to hazing, police opened a criminal investigation, and Penn State suspended the fraternity last month after sealing the results of its own investigation.
  • Last December, 19-year-old Pi Delta Psi pledge Michael Deng of Baruch College in New York died from major head trauma in what police said was a homicide.

Irvine's total breaks down to two homicides, 12 rapes, 38 robberies and 61 aggravated assaults, the Daily Pilot reported. Although 110 violent crimes were reported in the city in 2012, a spike in population of about 18,000 residents means Irvine's per-capita rate dropped, according to the FBI.


The city also experienced a decline last year in property crime. The city reported 3,304 burglaries, thefts, vehicle thefts and arsons in 2012 compared with a total of 3,285 in 2013.
