I'll agree with he last part, you should make sure you won't be driving before you start drinking, but I can't say that there's explicitly malicious intent when one makes the careless decision to do drive drunk.
I'd argue the negligence from driving a car while drunk constitutes a form of malice. Without getting into jurisprudence, though, the punishment for these cases of drunk driving need to be considered more seriously.
