I'll agree with he last part, you should make sure you won't be driving before you start drinking, but I can't say that there's explicitly malicious intent when one makes the careless decision to do drive drunk.
I'd argue the negligence from driving a car while drunk constitutes a form of malice. Without getting into jurisprudence, though, the punishment for these cases of drunk driving need to be considered more seriously.

I could've. It's a matter of interest for the entire forum, however. Yes, Dustin's been acting like an arse. Yes he's been provocative, idiotic and downright sanctimonious. However, there is no justification for locking his threads in the Serious board simply because he refuses to quit posting about a specific topic when said specific topic isn't forbidden. The moderation system has to be impartial.
