I'll agree with he last part, you should make sure you won't be driving before you start drinking, but I can't say that there's explicitly malicious intent when one makes the careless decision to do drive drunk.
I'd argue the negligence from driving a car while drunk constitutes a form of malice. Without getting into jurisprudence, though, the punishment for these cases of drunk driving need to be considered more seriously.

Murder is simply manslaughter but with malice aforethought and, supposedly, reduced culpability.

I don't think drink driving meets either of those exceptions.

I see no reason to believe in them. I remain open-minded about it, however, since there's a lot of 2sp00py shit out there.

Although, I'm incredibly sceptical, since a lot of it can be explained by psychology and neuroscience. Besides, I haven't seen anything to suggest that something could facilitate the existence of ghosts, let alone suggest that the ghosts themselves exist.

It's a matter of interest for the entire forum, however. Yes, Dustin's been acting like an arse. Yes he's been provocative, idiotic and downright sanctimonious.

However, there is no justification for locking his threads in the Serious board simply because he refuses to quit posting about a specific topic when said specific topic isn't forbidden. The moderation system has to be impartial.
