If anything, just do the theme and don't risk it with the gamerpics. They are visible to other people online, and they'd probably report it.
If it's gamerpics that exist or have previously existed in the marketplace, you're good.
If it's super custom shit, that's friends only, except that was done with a Live vision camera exploit.

Well thing is...I have seen custom gamerpics, but when I asked they said they used that xbox camera thingy that existed before the kinect. So....it's possible through other means and not something you'd get banned for
