Oddly enough, in a court, NSTR could use the argument that Vanilla WoW is abandoneware since Blizz had made is completely clear they won't bring back a Vanilla WoW despite people crying for it.

So private servers are operated and maintained on Blizzard resources?

Except Blizzard is behaving like it is, they're suing.

Nothing about operating with Blizzard's decade old assets upsets Blizzard's operation of their current product, like entering someone else's kitchen would.
