A while ago when my account was compromised, and some mexican bought a shit-ton of games on it. Fortunately the charges were reversed and refunded, and XBL was able to get my account back and add a few M$ Points (I think it was 1600 and a free month of Live).
What they forgot to do however, was remove the games from my purchase history. It still thought I'd "bought" them after the refund, so I waited a few months (in case MS noticed and tried to fix the problem and/or think I'd faked the account compromise), and then downloaded them. Most were crap arcade games to be fair, but L4D was nice.
Also, they've fixed it up the glitch or it wasn't working on the UK site, says it's £89 here.
Damn. That's quite a story. At least you got some free games from it.
Even funnier was that after I initially fought the guy to get my account back (I found out about it while I was playing, as apparently I'd "signed on at another location", and so recovered my account and changed the password, cancelled cards and all that), he then got on his own account and messaged me asking for the account back.
Stupid Mexican'ts.

You're not going to get banned from Xbox Live from a mistake they made. I got Bioshock for free on the Xbox 360 because of a glitch that happened with Xbox Live Rewards before and I still have my account.
In my case they took away my remaining 200 Microsoft Points at the time.
A few years ago I downloaded a demo for a game to try it out with a few friends. Next day I ended up getting banned from Xbox Live for a few days. I called Xbox Support and apparently a bunch of other people downloaded stuff around the same time I downloaded that demo and they got banned too.
It wasn't all bad, they gave me 1600 M$ points and a 3 month gold card for mistaking the ban.

I honestly have to agree with Deci and DAS.
While it does have those features that send data to third parties and other shady things. Almost all of it can be turned off and none of it affects your time on the computer, i've never had an issue with shady things happening as I am downloading mods for Skyrim from third parties(Nexus) or other things I won't mention, overall the OS works just fine. I've had 1 issue with it so far and that was because I fucked things up. However if you don't like it wait 4 years and see if Windows 10 is any more appealing and if it isn't you'll just have to work with Windows 8/8.1 or buy a Linux/Mac.

I don't use Mac and previous version of Windows did not have an aggressive advertising campaign as much as 10 did. Mostly because there was controversy on whether or not average build computers of those time frames could handle the new OS. I ran XP well until I got my laptop which came with 7 and never once received pushing for either Vista or 7.

I don't ever have to worry about W10 plaguing my computer because I'm running a unregistered version of 8.1, nor do I use Norton Anti-Virus. I personally don't ever have to worry about that hot garbage infecting my computer but that doesn't stop the fact that W10 is malware by every definition of Spyware and Adware. Software doesn't have to be "rogue" in order for it to be malicious. The idea that a company can not do anything malicious to its userbase is by far the most uneducated thing anyone could possibly have the audacity to say.

Because it's software coming from a "reputable" source (Microsoft is dead)? And just because it doesn't automatically upgrade on you doesn't mean it's still not forced. Aggressively advertising it and keeping that pop up on your task bar (I even have it on mine) is pushing it on people. Also, just because you can manually remove its spyware features doesn't mean it's not spyware. I can manually delete the files of a virus that has infested my computer, doesn't mean it's not a virus.
