As for custom gamerpics? What do you mean by that, like the gamerpics that are hard to find and no longer available except via USB with Horizon or Modio? If so, MS can't prove it's from those programs because you could easily just recover your account to a console that has those gamerpics already

So....it's possible through other means and not something you'd get banned for
