The fan translation only works on 3DSs that are below the 9.2 firmware update too and I think I updated mine recently.

I guess I could always use completely legal methods to play the Japanese version of the game and apply the fan translation that way.

No dude. The region-unlocking app in HBL works on any firmware. I just went ahead and bought JAP version of Conquest. The neat thing is another app let's you ROM hack at it and translate the text.
