On one hand he never would've paid for it if the game turned out to be shit. On the other maybe the devs wouldn't have deserved to be paid for making a shitty game.

What did he steal? Nothing was lost.

In fact the dev probably earned a sale because of this, more money then he would've gotten if said pirate got it over steam.

Yes they will. It's just hard to enforce. Though If you go up to a cop and saw to him "Oi m8, I just stole a game off the interwebs", their going to arrest you for theft.

By your logic, cops shouldn't arrest you for have 1 digital picture of child pornography because it's not as big of a deal as if he had a physical photo.
