At the end of the day it's people making games. If a bunch of dudes could make a better Halo 4 than 343i I'd pay them no problem. If somebody takes a mod and makes it a full game, they created a game. Why shouldn't they be paid?

I don't see how it's any different than the idea of building something with Legos that's not intended by the manual.
Looking at it from an artist's perspective is only covering a fraction of what goes into the original product. There's a much more technical backend keeping that art afloat; an extremely complex backend that some curious kid shouldn't be forced to develop from scratch just so they can explore the tiniest sliver of a concept like game AI, level design, or animation.
